Terms and Conditions (AGB)

1. Scope

These General Terms and Conditions (AGB) govern the use of the Alchema platform operated by EliteX GbR, based in Germany. By creating an account or using our services, you agree to these terms. These terms apply to all users, regardless of their country of residence within the European Union. These terms are provided in German as the authoritative version. This English translation is for convenience only.

2. Subject of the Contract

Alchema provides AI-powered job application tools including resume tailoring, cover letter generation, ATS score optimization, interview preparation, salary intelligence, and career coaching. All AI features are powered by Mistral AI and processed server-side within the EU. Alchema is a tool to assist with job applications -- it does not guarantee employment outcomes.

3. Registration and Account

To use Alchema, you must create an account using a valid email address or Google OAuth. You are responsible for maintaining the confidentiality of your login credentials. Each user may only maintain one account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Service Description

Alchema offers the following subscription tiers:

• Free (EUR 0/month): 5 AI actions per month, basic resume creation, job tracking.
• Student (EUR 9.99/month, EUR 6.99/month billed annually): 75 AI actions per month, unlimited resumes, interview prep, salary data, PDF and DOCX export. Requires university email verification.
• Pro (EUR 34.99/month, EUR 24.99/month billed annually): 300 AI actions per month, 100 auto-applies per month, full analytics, salary negotiation coaching.

5. Prices and Payment

All prices are stated in EUR and are final prices. No VAT is charged pursuant to Section 19 UStG (Kleinunternehmerregelung). Payment is processed securely via Stripe. Subscriptions are billed monthly or annually, depending on the plan selected. Pro-rated credits apply when changing plans mid-cycle. The free tier requires no payment information.

6. Credits and AI Usage

AI-powered features consume credits (called AI actions). Credits reset monthly. Unused credits do not carry over to the next month. Certain features (job extraction, email classification) are free and do not consume credits. All AI processing uses Mistral AI.

6a. Credit Packs

In addition to subscriptions, Alchema offers one-time credit packs:

• Starter: 25 credits for EUR 4.99 (one-time payment)
• Boost: 60 credits for EUR 9.99 (one-time payment)
• Power: 150 credits for EUR 19.99 (one-time payment)

Purchased credits do not expire.

Pack credits are consumed on a first-expiry-first-out (FEFO) basis: the oldest pack credits are used before subscription credits.

Credit packs are digital content within the meaning of BGB S356(5). After confirmation of the waiver of withdrawal rights and immediate provision of credits, refunds are excluded.

Before purchasing a credit pack, you will be asked to expressly waive your right of withdrawal. The purchase cannot be completed without this consent.

6b. Dispute Resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board. The European Online Dispute Resolution platform (ODR) was discontinued on July 20, 2025.

7. Right of Withdrawal

As an EU consumer, you have the right to withdraw from a paid subscription within 14 days of purchase without giving any reason (EU Directive 2011/83/EU). To exercise this right, contact us at contact@alchema.eu with your account email and a clear statement of withdrawal. Upon withdrawal, we will refund all payments within 14 days using the same payment method. If you have used AI actions during the withdrawal period, the refund may be reduced proportionally.

8. Limitation of Liability

EliteX GbR is fully liable for damages caused by intent or gross negligence, and for injury to life, body, or health regardless of the degree of fault. Liability for slight negligence is limited to foreseeable, contract-typical damages arising from the breach of material contractual obligations (cardinal obligations). The total liability for damages under slight negligence shall not exceed the total fees paid by the user in the 12 months preceding the event giving rise to the claim. AI-generated content (resumes, cover letters, interview answers) is provided as suggestions only. Users are responsible for reviewing and verifying all AI-generated content before submission to employers. Alchema does not guarantee the accuracy, completeness, or suitability of AI-generated content.

9. Data Protection

We process personal data in accordance with the General Data Protection Regulation (GDPR) and German data protection law (BDSG). For full details, please see our Privacy Policy.

10. Cancellation

Paid subscriptions can be cancelled at any time through the Stripe billing portal accessible from your account settings. Upon cancellation, your subscription remains active until the end of the current billing period. After the billing period ends, your account reverts to the free tier. Your data (resumes, applications) is retained and accessible on the free tier.

11. Changes to Terms

We may update these terms with at least 30 days advance notice via email. Continued use of the service after the effective date constitutes acceptance of the updated terms. If you do not agree with the changes, you may cancel your subscription before the effective date.

12. Final Provisions

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, mandatory consumer protection provisions of their country of residence apply in addition. If any provision of these terms is found to be invalid, the remaining provisions shall continue in full force and effect. The place of jurisdiction for merchants is the seat of EliteX GbR.
